The Punishment You Should Expect With a DUI in Florida

It is always better to think twice before getting behind the wheel when having a couple of drinks. Driving under the influence of alcohol could be a serious offense, especially in Florida where once convicted of a DUI, there is no chance of having it removed from your record! - Well, not for 75 years.

As the rules change from state to state, punishment for DUI in Florida also changes accordingly. There is no consistent punishment for driving while under the influence. However it's important to note that Florida has some of the strictest DUI laws in the country.

The punishment for DUI in Florida depends on several factors such as the number of previous convictions, circumstances of the case, injury or harm to property due to your DUI charge and worst of all, if your drunk driving incident results in the injury or death of someone. Killing someone in Florida while driving drunk can land you in prison for a maximum of 15 years!

For a first time offense in Florida, the penalty is relatively less severe. The punishment will involve fines, maybe probation, community service, a suspended driver's license, DUI school and possibly jail time. Whereas the amount of the fine is much smaller for a first offense in Florida, second-time conviction fines can be quite a bit more than other states.

Florida's second offense fines are between $2,000 and $5,000 whereas in states like Virginia we are only talking about fines of $250 to $2,500. - And again, Florida, unlike some of the other states, keeps a DUI charge on your record for 75 years.

Some very important factors that will impact your drunk driving penalties in Florida are your blood alcohol levels at the time of arrest, and if children were in the car. If this happens things are going to get much worse for you in the state of Florida. If your blood alcohol concentration is.15 when you are arrested for drunk driving, or if you have a child in the car, a jail sentence of no more than 9 months will be issued. Ouch!

The severity of punishment will increase as the number of convictions increase. Repeated DUI offenses can often end up in felony DUI convictions and could result in jail time.

Often times, judges will require offenders to install an ignition interlock on the car. This is an electronic device, which tests the sobriety of a driver before he/she can start the vehicle. If any traces of alcohol are detected in the breath, the device will not let the person crank the vehicle.

Punishment for DUI in Florida has become substantially more severe over the past few years. The goal obviously is to cut back on the number of DUI cases in Florida. This is because the state of Florida had an astonishing 61,852 DUI arrests in 2015 with Miami-Dade County having 1,202 deaths as a result of drunk driving.
